Client Rights

Privacy, Confidentiality, and Your Records

Federal and state laws require The Art of Living Therapy to: Protect your privacy and the

confidentiality of your records. Allow you to access information maintained about you upon request.

Explain why and how your information may be used or shared. Inform you of your rights regarding

your personal information.

Your Records

Client records at The Art of Living Therapy are considered private and confidential under the

Minnesota Data Privacy Act and the Health Insurance Portability and Accountability Act of 1996

(HIPAA).

These records are the legal property of The Art of Living Therapy. Clients may review information

contained in their records, except when such access may be deemed potentially harmful to their

well-being. Information will only be released to others with your written, informed consent.

You may specify what information may be shared and how. It is recommended that records only be

released to other licensed professionals with a legitimate need for the information.

If you have any questions or concerns about your privacy or records, please reach out directly.

Exceptions to Privacy

Confidentiality will be maintained except in the following legally required situations: Threats of harm:

If you threaten to harm someone, I may be required by law to warn that person or notify law

enforcement. Threats to the President: If you threaten the President of the United States or the

President-designate, I must report it to the Secret Service. Abuse or neglect: If I suspect physical or

sexual abuse of a child or vulnerable adult, or if a pregnant individual is using illicit substances, I am

mandated by law to report it to the appropriate authorities. I work collaboratively with child protection

services when necessary to ensure the safety and support of families.

Access to Your Records

You have the right to review both public and private records maintained about you. Access may take

a few business days to arrange. You may also authorize another individual or professional to review

your records.

Viewing your records is free of charge; however, a reasonable fee may apply if you request copies.

Please schedule an appointment to review your records.

Access by Government Agencies

Certain government agencies may, by law, access specific information if they provide services to you

or to The Art of Living Therapy that affect your care. Agencies that may have access include

(depending on your program): Minnesota Department of Human Services County welfare or human

services agencies responsible for funding your care The judiciary, pursuant to a valid court order

County protection teams in cases of suspected abuse or neglect Any individual or agency you

authorize in writing Details about information sharing are outlined on forms you complete when

applying for services. You may also request clarification from staff at any time.

Purposes for Collecting Information

Information collected by The Art of Living Therapy or authorized for collection serves the following

purposes (as applicable to your care): To provide appropriate and effective mental health treatment

To document and justify your treatment as required by the State of Minnesota To assist in developing

treatment guidelines or quality improvement measures Any other purpose expressly authorized by

you.

Other Rights

You have the following rights under state and federal law: To refuse to provide information not

required for participation in a government-funded program. To refuse to provide information,

understanding that certain services may require it for eligibility. To challenge the accuracy of

information in your records by submitting a written request. Responses will be provided within 30

days. To include your own written explanation in your file regarding any disputed information. To

appeal any decision made about your records.

Your notice of appeal must include: Your name, address, and phone number A statement identifying

the Department of Human Services as responsible for your records The name of the agency involved

in your appeal A description of the nature of the dispute and the data involved The desired outcome

Appeals must be filed within 60 days of the action being appealed.

Client Bill of Rights

As a client of The Art of Living Therapy, you have the right to: Expect that your therapist meets

professional training and experience standards. Be informed of your therapist’s credentials. Be

informed of the cost of services before receiving them. Receive services in a confidential and

professional manner, as defined by law. Be free from discrimination on the basis of race, religion,

sex, age, disability, or any other protected status. Be informed about appropriate ways to report

complaints.
